The terms governing your use of the OMHAS website, learner portal, training, and consulting services.

Section 01

Acceptance of Terms

By accessing or using any OMHAS Solutions Inc. ("OMHAS") website, learner portal, training course, or consulting service, you ("you", "learner", "client") agree to be bound by these Terms & Conditions. If you do not agree, you must not use our services.

These terms apply alongside any signed Statement of Work, Master Services Agreement, or course enrollment contract you have with us. Where conflict arises, the signed contract prevails.

Section 02

Description of Services

OMHAS provides workplace safety training, certification, consulting, auditing, and prequalification support services to organizations and individual learners across Ontario, Canada.

Training is delivered online through our learner portal, in person, or in blended formats. Consulting and auditing services are scoped through individual engagement agreements.

Section 03

Accounts & Eligibility

You must be at least 16 years of age to create a learner account. Corporate accounts may be established by an authorized representative of the organization.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized access.

Section 04

Payment & Refunds

Course fees are payable in advance unless an invoice arrangement is in place. All prices are in Canadian dollars and exclusive of applicable taxes (HST).

Refunds are available within 30 days of purchase for courses not yet started, or where less than 25% of course content has been completed. Certificates already issued cannot be refunded.

Section 05

Certificates

Certificates are issued upon successful completion of all course assessments at the published pass mark. Certificate validity periods are stated on each course page.

Certificates are personal to the named learner and are non-transferable. Fraudulent representation of a certificate is grounds for immediate revocation and may be reported to applicable regulators.

Section 06

Intellectual Property

All course content, training materials, templates, and software are the exclusive property of OMHAS or its licensors and are protected by Canadian and international copyright law.

You receive a limited, non-exclusive, non-transferable license to access and use our materials for your own training purposes. You may not reproduce, redistribute, or use our materials to deliver training to third parties without written authorization.

Section 07

Acceptable Use

You agree not to interfere with the operation of our services, attempt unauthorized access, share login credentials, automate the consumption of course content, or use our services in any unlawful manner.

Violation may result in account suspension, certificate revocation, and reporting to relevant authorities.

Section 08

Disclaimers

Our services are provided on an "as is" and "as available" basis. We do not warrant that our services will be uninterrupted, error-free, or perfectly suited to your specific operational needs.

Training content reflects best-practice interpretation of Ontario regulatory requirements at the time of authoring. You remain responsible for applying training appropriately within your workplace and for compliance with all applicable laws.

Section 09

Limitation of Liability

To the maximum extent permitted by law, OMHAS shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our services.

Our aggregate liability shall not exceed the total fees paid by you to OMHAS in the twelve months preceding the claim.

Section 10

Indemnification

You agree to indemnify and hold harmless OMHAS, its directors, employees, and agents from any claim arising from your breach of these Terms or your unlawful use of our services.

Section 11

Termination

We may suspend or terminate your access to our services at any time for breach of these Terms or for any other reason at our reasonable discretion. Provisions that by their nature survive termination shall continue in effect.

Section 12

Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. The courts of Ontario have exclusive jurisdiction over any dispute.

Section 13

Changes to These Terms

We may amend these Terms from time to time. Material changes will be communicated by email to active account holders and posted on this page. Continued use of our services after a change constitutes acceptance.
